These Story Submission Terms (“Terms”) apply when you submit a story, message, photo, audio, video, or any other content (your “Story”) to The Miracle Project LLC (“we,” “us,” or “our”) through our website at www.themiracleproject.co or through any other way we invite you to share a Story. By submitting a Story, you agree to these Terms. If you do not agree, please do not submit a Story.
1. Your permission and the rights you give us
When you submit a Story, you give us your permission to use and share it. Specifically, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable, and sublicensable right to use, copy, store, edit, adapt, translate, combine with other material, reproduce, publish, perform, display, and distribute your Story, in whole or in part, in any and all media now known or later developed, including our website, podcast, emails, social media, printed materials, and promotional materials. This permission includes the right to use your name, city/state or country, and any image, likeness, or voice you include in your Story, in connection with publishing and promoting your Story and our project. You will not be paid for your Story or for any use of it (see Section 5).
2. Your promises to us
By submitting a Story, you represent and promise that:
It’s yours to share. You own or control all rights in your Story, and you have full authority to give us the permissions in Section 1.
It doesn’t belong to someone else. Your Story is original to you and does not copy, infringe, or violate anyone else’s copyright, trademark, privacy, publicity, or other rights.
It’s truthful. Your Story is accurate to the best of your knowledge and is not false, misleading, or defamatory.
You have any needed consents. If your Story identifies, describes, or includes the name, image, voice, or private information of any other person, you have that person’s permission to share it with us and to have it published (see Section 3).
You’re an adult. You are at least 18 years old and able to enter into these Terms (see Section 4 for children).
3. Stories that mention other people
Miracle stories often involve family members, friends, caregivers, or others. If your Story names, shows, or reveals private details about another person, you confirm that you have their permission to share those details with us and to have them published. Please do not share someone else’s private or medical information, name, or image without their consent. You are responsible for getting any permissions needed from the people in your Story.
4. Stories by or about children
You must be at least 18 years old to submit a Story. If you want to submit a Story on behalf of a child under 18, or a Story that identifies or is about a child under 18, you confirm that you are the child’s parent or legal guardian (or have the parent’s or guardian’s written permission) and that you agree to these Terms on the child’s behalf.
5. How we may use your Story; editing; no obligation; no payment
We may edit. We may edit, shorten, adapt, or combine your Story for length, clarity, style, or presentation, consistent with our editorial judgment. We keep full editorial and creative control over what we publish and how.
We don’t have to use it. We are not required to use, publish, or keep your Story, and we may remove it at any time.
No payment. You are not entitled to any payment, credit, or compensation for your Story or for any use of it.
6. No confidentiality
Please do not send us anything you consider confidential or secret. We treat Stories as non-confidential. Submitting a Story does not create any confidential, fiduciary, or special relationship between you and us.
7. Disclaimers
Our website and the Stories we publish are provided “as is” and “as available.” Stories reflect the personal experiences and views of the people who submit them, not us. We do not verify, endorse, or guarantee the accuracy, completeness, or reliability of any Story, and we are not responsible for the content of Stories submitted by others. To the fullest extent allowed by law, we disclaim all warranties of any kind, whether express or implied.
8. Release and limitation of liability
To the fullest extent allowed by law, you release The Miracle Project LLC and its owners, members, managers, employees, contractors, partners, sponsors, successors, and assigns (together, the “Released Parties”) from any and all claims, demands, and liability arising out of or relating to our collection, editing, use, publication, or removal of your Story, including any claim based on how your Story is edited, presented, or combined with other material.
To the fullest extent allowed by law, the Released Parties will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits or lost data, arising out of or relating to your Story, these Terms, or your use of our website. If, despite this, any Released Party is found liable, their total combined liability to you will not exceed one hundred U.S. dollars (US $100).
9. Your responsibility to protect us
To the fullest extent allowed by law, you agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your Story; (b) your breach of these Terms or of any promise you made in Section 2; or (c) your violation of any law or of anyone else’s rights in connection with your Story.
10. Governing law and where disputes are resolved
These Terms, and any dispute arising out of or relating to them or to your Story, are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, regardless of where you live or submit from. You agree that any dispute will be brought only in the state or federal courts located in Palm Beach County, Florida, and you consent to the jurisdiction of those courts.
11. Changes to these Terms
We may update these Terms from time to time. The version in effect when you submit a Story applies to that Story. Any change takes effect when we post the updated Terms on our website.
